This document contains the Terms and Conditions governing your use or access of the SM Cinema Website, Application and other selling channels on the purchase of any movie tickets, goods or services from SM Cinema, and participation in any competition organized by SM Cinema. If you do not agree to these Terms and Conditions, do not use or access the SM Cinema Service, the SM Cinema Website, Application and other selling channels. SM Cinema reserves the right to change these Terms and Conditions from time to time at its sole discretion and without notice. Your continued use or access of the SM Cinema Service, the SM Cinema Website, Application and other selling channels, as revised by any and all changes to the Terms and Conditions so published and/or posted, constitutes your acceptance of such changes. We strongly recommend that you review the Terms and Conditions whenever you use or access the SM Cinema Website, Application and other selling channels and prior to your use or access of the SM Cinema Services. You can review the most current version of these Terms and Conditions at any time.

SM Cinema Services are available only to, and may only be used by individuals who can form legally binding contracts under the law. Without limiting the foregoing, the SM Cinema Services are not available to children (persons under the age of eighteen (18) years old). If you are under the age of eighteen (18) years old, you can use the SM Cinema Services only under the supervision of your parents or guardian/s.

Prior to any purchase of SM Cinema Services from or through the SM Cinema Website, Application and other selling channels, or before participating in any competition organized by SM Cinema on the SM Cinema Website, you are required to register online as a member or a guest. Registration and joining as a member may be done in two ways – Basic or Premium. You may be asked to provide personal information (including mobile number and address) to SM Cinema when registering as a member or a guest.

You hereby consent (i) to the collection, recording, organization, storage, updating, retrieval, consultation, use, consolidation, transfer, sharing, and/or processing of your personal information and sensitive personal information, by SM Cinema and its related corporations and affiliates (collectively, "SM Cinema Group"), their agents and authorized service providers, in order to review, process, implement or perform acts in relation to the use or access of the SM Cinema Services, the SM Cinema Website, Application and other selling channels and (ii) to the SM Cinema Data Privacy Policy found at https://smcinema.com/Browsing/General/Privacy. You are solely responsible for creating, submitting, protecting and safeguarding your personal information which you will provide SM Cinema for processing in accordance with the SM Cinema Data Privacy Policy and these Terms and Conditions.

You acknowledge that no data transmission over the internet can be completely secure, and SM Cinema cannot give an absolute assurance that your personal information will be completely secure at all times. If you object to any of the foregoing, please do not use the SM Cinema Services.

Employees of SM Cinema, their relatives and SM Cinema’s related corporations and affiliates are entitled to become members of the SM Cinema Website, but are not entitled to participate in any competition organized by SM Cinema on the SM Cinema Website; provided further that, this limitation extends to such employees' relatives up to the 3rd degree of consanguinity and affinity.

Without limiting other remedies, SM Cinema may at its sole discretion limit your activity, temporarily or indefinitely suspend or terminate your membership and/or your use or access of the SM Cinema Website, Application and other selling channels, and refuse to provide SM Cinema Services to you if: (a) you breach any Terms and Conditions hereof or any terms incorporated by reference; (b) we are unable to verify or authenticate any information provided to us which we deem is requisite and necessary; or (c) we believe that your actions, , whether or not related to your use or access of the SM Cinema Services, the SM Cinema Website, Application and other selling channels, may cause any losses, claims, damages, liabilities and expenses, including financial losses or legal liabilities, to us.

SM Cinema is providing this facility as an alternative mode of purchasing movie ticket(s) and makes no representations or warranties of any kind, express or implied, with respect to the SM Cinema Services, the SM Cinema Website, Application and other selling channels or the information, content, products or services included in these channels. In no circumstances shall SM Cinema its parent company, affiliates, directors, stockholders, officers, employees and/or agents be liable for any losses, claims, damages, liabilities, expenses, and/or costs of litigation in relation to the use or access of the SM Cinema Services, the SM Cinema Website, Application and other selling channels. As such, you shall (a) hold free and harmless and (b) indemnify SM Cinema, its parent company, affiliates, officers, directors, stockholders, employees and/or agents from and against any losses, claims, damages, liabilities, expenses, and/or costs of litigation in relation to the use or access of the SM Cinema Services, the SM Cinema Website, Application and other selling channels. The SM Cinema Website is currently to be used for the purchase of SM Cinema movie ticket(s) and other products and services being offered.

SM Cinema does not warrant that the use or access of the SM Cinema Services, the SM Cinema Website, Application and other selling channels will (1) be uninterrupted; (2) be free from inaccuracies, errors, viruses or other harmful components; (3) meet your requirements; or (4) operate in the configuration or with the hardware or software you use. If you are dissatisfied with the SM Cinema Services, the SM Cinema Website, Application and other selling channels or any of their contents, or with the Terms and Conditions, your sole and exclusive remedy is to discontinue using or accessing the SM Cinema Services, the SM Cinema Website, Application and other selling channels. You acknowledge that your use or access of SM Cinema Services, the SM Cinema Website, Application and other selling channels is at your sole risk.

In the event any applicable law does not allow the limitation of liability set forth above or any part of this limitation on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of SM Cinema under such circumstances for liabilities that otherwise would have been limited shall not exceed the price you paid for the purchase of SM Cinema movie ticket(s) or such other products and services offered via the SM Cinema Service, the SM Cinema Website, Application and other selling channels.

The SM Cinema Service, the SM Cinema Website, Application and other selling channels are for your personal and non-commercial use. Unless otherwise agreed to in writing by SM Cinema, you agree that you will not use, duplicate, download, publish, modify or otherwise distribute any material included in the SM Cinema Service, the SM Cinema Website, Application and other selling channels for any purpose, except to review the information included in therein, to subscribe to programs included therein, and to purchase movie ticket(s) or such other products and services offered therein for your personal use. You also agree that you will not link any page on the SM Cinema Service to page/s other than the home page of the SM Cinema Website, Application and other selling channels, without SM Cinema's prior written consent. Use or access of the SM Cinema Service, the SM Cinema Website, Application and other selling channels or the materials or content contained therein for any purpose not set forth in these Terms and Conditions is prohibited.

You acknowledge and agree that the copyright and other intellectual property rights in the SM Cinema Services and in all information and materials on the SM Cinema Website, Application and other selling channels (collectively, the “Intellectual Properties”) are owned by SM Cinema, its respective affiliates, suppliers or licensors unless otherwise expressly indicated. The Intellectual Properties are protected by Philippine and international copyright and trademark laws.

You agree that you will not do any of the following without SM Cinema's written permission:

  1. use SM Cinema's Intellectual Properties, except for printing out a copy of the SM Cinema Website or as part of a reference to an SM Cinema product or service;
  2. reproduce, copy, modify, merge, adapt, translate, re-publish, frame, upload to a third party, post, transmit, broadcast, communicate to the public or otherwise make the Intellectual Properties available to the public;
  3. transmit or display the Intellectual Properties on any computer, system or network which permits electronic access by more than one user at a time;
  4. use, sell, assign, rent, sub-license or otherwise deal with the Intellectual Properties except as permitted by the Terms and Conditions; or
  5. anything else which would infringe SM Cinema's or its affiliate/s’ rights or the rights of SM Cinema's content suppliers or licensors.


You may view the SM Cinema Website, Application and other selling channels using a web "browser" so long as you do not change the form of copyright and other proprietary notices. If you are interested in a piece of content solely for your own personal and non-commercial use, you may save, print or download a single copy only.

A. TICKETS & FOOD

Movie ticket(s) purchased through the SM Cinema Services, the SM Cinema Website, Application and other selling channels are strictly non-cancelable and non-refundable under whatever circumstances, except: (a) when the movie itself has been canceled/re-scheduled, or (b) if the cinema(s) concerned will not operate, cannot operate or cannot continue to operate on the date stated in the purchased movie ticket(s) for any reason whatsoever. Refunds will be effected through the same medium by which the Purchaser bought the ticket(s) (e.g. credit card, debit card, mobile wallets).

A non-refundable PHP 20.00 (Philippine Peso) online fee will be charged for every ticket purchased via the SM Cinema Services, the SM Cinema Website, and/or Application.

The Purchaser must bring along the e-voucher(s)/ e-movie ticket(s) upon arrival at the cinema on the scheduled movie screening for admission.

Movie tickets are made available subject to the classification of the relevant film given by the Movie and Television Review and Classification Board (MTRCB). SM Cinema has a legal obligation to refuse admission to any person, who in the opinion of its Branch Management Team, is under the minimum age required for R-13 and R-18 classified movies/films. Proof of age may be required in certain instances.

Movie tickets and food purchased through the SM Cinema Services, the SM Cinema Website, Application and other selling channels are redeemable only until the screening time and duration of the movie for which the ticket(s) was/were purchased. Once screening time has lapsed, the movie ticket(s) and the food purchased in relation thereto will be considered unredeemable and shall remain non-cancelable and non-refundable.

You represent and warrant that (a) any credit information you supply is true and complete; (b) charges incurred by you will be honored by your credit card company; and (c) you will pay the charges incurred by you at the posted prices, including any applicable taxes.

All payments made through bank payment gateways, mobile wallets, and/or other similar payment platforms are subject to the terms and conditions of each bank and/or service provider. SM Cinema has no authority over any payments made through the bank payment gateway, mobile wallets and/or other similar payment platforms. SM Cinema does not retain your payment details or any other significant information such as your credit card number, passwords, pin number etc. Payment details may be securely held by the bank and/or service provider which processes your transaction.

B. BLOCK SCREENING, THEATER RENTALS

  1. SM Cinema will only honor fully-paid reservations within the required booking period, i.e., at least four (4) days prior to the scheduled date.
  2. Rescheduling will only be allowed within seventy-two (72) hours prior to original scheduled date. Non-refundable rebooking fees apply.
  3. SM Cinema will only allow a maximum of one (1) rescheduling. The failure to appear on the rebooked schedule, regardless of the cause thereof, shall result in forfeiture of the booking.
  4. All confirmed bookings will promptly start as stated on the agreed schedule.

C. SM Event Screen

  1. SM Event Screen facilities may be reserved through online and on-site transactions and will be subject to cinema availability.
  2. Paid reservations are strictly non-cancelable and non-refundable under whatever circumstance except: (a) when the movie itself has been canceled/re-scheduled or (b) if the cinema(s) concerned will not operate, cannot operate, or cannot continue to operate at the date stated in the purchased reservation for any reason whatsoever. Refunds will be effected through the same medium by which the Purchaser bought the tickets (e.g., credit card, debit card, mobile wallets). The refund of payments made by means of non-SM Cinema gift certificates may only be effected through the registration by the customer as a member under the SM Cinema Club Program and the crediting of the amount equivalent to the refund amount to customer’s Club e-wallet under the SM Cinema Club Program.
  3. Rescheduling will only be allowed within seventy-two (72) hours prior to original scheduled date. Non-refundable rebooking fees apply.
  4. SM Cinema will only allow a maximum of one (1) rescheduling. The failure to appear on the rebooked schedule, regardless of the cause thereof, shall result in forfeiture of the booking.
  5. All confirmed bookings will promptly start as stated on the agreed schedule.
  6. Customer warrants that all streaming and gaming content shown during the booking is viewed/used/accessed through his/her personal account and/or property only, and will solely be for private viewing/use/access and not for public exhibition, publication, distribution, circulation or dissemination in any way.
  7. Customer shall sign a waiver to acknowledge that he or she, or his/her authorized representative, has had an opportunity to personally inspect the equipment and finds it suitable for his or her needs and in good condition and that he or she understands its proper use. Customer further acknowledges his or her responsibility to inspect the equipment prior to its use.
  8. Use of the rental equipment in the following circumstances is prohibited: a) use for illegal purpose or in an illegal manner; b) use when the equipment is due for repair works or is unsafe to operate; c) improper or unintended use or misuse; d) use for explicit and inappropriate content; and (e) any other uses analogous to the foregoing.
  9. Customer agrees to return the equipment and all accessories thereof immediately upon termination of the reservation and without need for demand. If not returned in a timely manner, Customer shall pay an additional charge as may be determined by SM Cinema.
  10. Customer agrees to pay for any damage or loss caused to the goods, the equipment and all accessories thereof, regardless of the reason(s) or such damage or loss, except reasonable wear and tear, while the same are not in the possession of SM Cinema. Any goods, equipment or accessories which are damaged beyond repair shall be paid for by the Customer at its full replacement value.
  11. For the avoidance of doubt, the reservation of the cinema venue and all equipment shall not be considered or deemed a contract of sale or as a sale/transfer/conveyance of the cinema venue and all equipment.

D. GIFT CARDS

  1. Gift Card(s) can be used for movie admission(s), or for purchase of food & beverage items available from SM Cinema and Snack Time.
  2. SM Cinema shall not be liable or responsible for lost or stolen Gift Card(s).
  3. The Customer shall be responsible for keeping his/her Gift Card(s) safe and secure.
  4. Gift Card(s) cannot be reloaded with any additional peso value.
  5. If the purchase amount is more than the current credit amount available on the Gift Card(s), the Customer can pay the difference using another type of tender accepted by SM Cinema.
  6. If the purchase amount is more than the current credit amount available on the Gift Card(s), the Customer can pay the difference using another type of tender accepted by SM Cinema.
  7. Gift Card(s) and any amount standing in credit on the Gift Card(s) cannot be redeemed wholly or partially for cash and no cash advances can be made at any time, regardless of whether there have been one or more transactions on the Gift Card(s).
  8. The remaining balance in Gift Card(s) may be used for succeeding transactions.
  9. The balances of several Gift Cards cannot be consolidated onto a new Gift Card.
  10. No refunds, other than those required by law, will be given after the date of purchase of the Gift Card(s).
  11. Gift Cards cannot be transferred or sold without the prior written permission of SM Cinema.
  12. Gift Card(s) will be void, will not be redeemable and will not produce the effect of payment if they are defaced, mutilated, altered or tampered with in anyway. SM Cinema may subject Gift Card(s) to verification and security checks in its absolute discretion.

E. SM CINEMA SAFE MOVIE WATCHING

SM Cinema shall implement all health and safety protocols required by the Philippine government, including the pertinent guidelines issued by the Inter-Agency Task Force for the Management of Emerging Infectious Diseases and the local government units (LGUs).


SM Cinema reserves the right to refuse admission to any Customer who violates any of the foregoing health and safety protocols.


F. SM CINEMA CLUB PROGRAM

Participation in the SM Cinema customer club program is subject to the following terms and conditions. As a member of the club program, you must comply with these terms and conditions. SM Cinema reserves the right to modify these terms and conditions, or any aspect of the club program, at any time, without notice to you. Participation in this club program is considered acceptance of the terms and conditions and any subsequent modifications, updates, or notices related thereto. If at any time, you do not accept the terms or conditions or become dissatisfied with this program, your sole remedy is to terminate your participation and membership in the SM Cinema Club Program. SM Cinema club members can accumulate points for eligible purchases made in all SM Cinema box offices and concession stands, and may redeem those points for various rewards. Additional membership benefits, which may change periodically, may include other discounts, coupons, and special offers which will be communicated in special members only emails. Participation in SM Cinema’s club program and the determination of and the entitlement to the benefits offered are at the sole discretion of SM Cinema.


Eligibility and Enrollment

Enrollment in the SM Cinema Club Program is done in two ways – Basic and Premium. Eligible purchases may serve as basis to earn and redeem points.


SM Cinema Club Program is open to individuals eighteen (18) years of age and older who reside in the Philippines. Persons who meet these eligibility requirements may enroll in the program by signing up here.


SM Cinema Club Program accounts are limited to one account per person. In the event a member has multiple accounts, the balances from those accounts cannot be combined and the accounts cannot be merged.


A Customer will be liable for any transactions that occur with his/her membership account, and he/she will not receive reimbursement for any rewards provided pursuant/in relation to the unauthorized or improper use of his/her membership account.


When you register on the SM Cinema Club Program, you will be asked to enter an e-mail address and password. This will allow you to access your membership account to check your point balance and update your account information. You are fully responsible for maintaining the security, confidentiality and the accuracy of your account information.


SM Cinema, its parent company, affiliates, directors, stockholders, officers, employees and/or agents shall not responsible for any losses, claims, damages, liabilities, expenses, and/or costs of litigation you may incur as a result of or in relation to any unauthorized use, access, disclosure or processing of your e-mail, password, or any account information.


All information that you provide to SM Cinema in connection with your participation in the club program must be true and complete. You are responsible for updating your account information so that it remains true and complete at all times.


Earning Points

To earn points online, you must log in to your membership account prior to purchasing movie tickets or concession items on the SM Cinema Website. Points are generally earned at the rate of 1 point for every Fifty Pesos (PhP50.00) of the total purchase price of the purchased eligible movie ticket/s and/or concession item/s for Basic membership and 1 point for every Twenty-Five Pesos (PhP25.00) of the total purchase price of the purchased eligible movie ticket/s and/or concession item/s for Premium membership. The foregoing notwithstanding, SM Cinema may, at its sole discretion, determine that some items or tickets may earn points at a different rate. Additionally, bonus points may be earned in conjunction with special offers that will be emailed periodically to those members who have opted in to email communications. SM Cinema points have no cash value and are not considered to be property of the SM Cinema member. Rewards issued in conjunction with the club program also have no cash value.


Purchase of Gift Card is not eligible for earning points. Points can be earned upon usage thereof.


Redeeming Points

Redemption of points may be done by presenting your club number to the SM Cinema cashier at the ticket counter for account and points balance verification. Upon verification by the SM Cinema cashier, the available points of the membership account may be used to effect payment for eligible movie ticket(s) and/or concession item(s) purchased through the ticket counter. The available points of the membership account may only be used for purchases made through ticket counters and may not be used to effect payment for any online purchase made through the SM Cinema Website, Application and other selling channels. When redeeming points, the unexpired points which were earned the earliest are used first in effecting payment for the purchase/s made through ticket counters. Unused points (i.e. unredeemed points or points which were not utilized to effect payment for purchases made through ticket counters) expire after twelve (12) months from the time they were earned.


Expiration of Cinema Points

Unused points (i.e. unredeemed points or points which were not utilized to effect payment for purchases made through ticket counters) expire after twelve (12) months from the time they were earned.


Termination of Membership

SM Cinema reserves the right to modify these terms and conditions, or any aspect of the club program, at any time, without notice to you. Participation in this club program is considered acceptance of the terms and conditions and any subsequent modifications, updates, or notices related thereto. If at any time, you do not accept the terms or conditions or become dissatisfied with this program, your sole remedy is to terminate your participation and membership in the SM Cinema Club Program at any time, and SM Cinema, its parent company, affiliates, directors, stockholders, officers, employees and/or agents shall not responsible to the member for any unspent points or unused rewards. SM Cinema reserves the right, in its sole discretion, to rescind credits and rewards and/or to disqualify you from membership in the SM Cinema Club Program and/or to terminate your membership immediately and without notice if, in the sole judgment of SM Cinema, you (i) violate these terms and conditions, (ii) engage in any fraud or abuse relating to eligibility for SM Cinema Club Program membership, accrual of points, or redemption of points and rewards, (iii) misrepresent any information supplied by you to SM Cinema and (iv) any other reasons analogous to the foregoing.


Your Premium membership will expire after 12 months from date of admission to the Premium membership program, unless otherwise renewed. Once your Premium membership expires, you will be automatically enrolled under Basic membership. Any unused and unexpired points will be retained in your current membership. Your Basic membership shall subsist and remain effective until you opt out of your membership. You may opt out of your membership anytime.


Membership Renewal

Annual fees will apply for renewal of Premium membership. Unused points and load from previous membership will be carried over upon renewal.



Privacy

Any personal information collected in the administration of this program is processed exclusively for the purpose of operating/implementing the SM Cinema Club Program, and will not be sold or provided to any third party except for those who have been contracted to assist in the operation/implementation of the SM Cinema Club Program.


Right to Modify / General Provisions

SM Cinema reserves the right in its sole discretion to modify or update these terms and conditions and/or change, alter, or discontinue the SM Cinema Club Program (including its points and rewards structure), the list of participating cinemas, or any rewards at any time without any liability or notice to members beyond updating these terms and conditions. The result of such modification, update, change, alteration or discontinuation may include the decrease in redemption value or cancellation of credit not yet redeemed.


SM Cinema reserves the right to modify or discontinue, temporarily or permanently, the SM Cinema Website, Application or other selling channels, or any part thereof, with or without notice. You agree that SM Cinema, its parent company, affiliates, directors, stockholders, officers, employees and/or agents shall not be liable to you or any third party for any modification, suspension or discontinuance of the SM Cinema Services, the SM Cinema Website, Application and other selling channels, for any reason. SM Cinema does not guarantee continuous, uninterrupted or secure use or access to or operation of the SM Cinema Services, the SM Cinema Website, Application and other selling channels which may be interfered with by numerous factors outside of SM Cinema’s control. In addition, the SM Cinema Services, the SM Cinema Website, Application and other selling channels could be unavailable during certain periods of time while they are being updated and modified.

SM Cinema provides hyperlinks to third party sites ("Linked Sites") for convenience only, and the inclusion of the hyperlinks does not imply any endorsement of the Linked Sites by SM Cinema or its parent company, affiliates, directors, stockholders, officers, employees and/or agents. In addition, the inclusion of third party advertising on this Website (whether with or without hyperlinks) is not an endorsement or recommendation of the third party advertiser by SM Cinema or its parent company, affiliates, directors, stockholders, officers, employees and/or agents.

You acknowledge and agree that Linked Sites are not under the control of SM Cinema its parent company, affiliates, directors, stockholders, officers, employees and/or agents and that SM Cinema, its parent company, affiliates, directors, stockholders, officers, employees and/or agents shall not be liable or responsible for:

  1. any act, omission or negligence of any person who administers or owns any Linked Site;
  2. the copyright compliance, legality or decency of any Linked Site;
  3. the accuracy or reliability of any information provided by any Linked Site;
  4. any goods or services provided by any person who administers or owns any Linked Site; or
  5. the performance of any obligations owing to by any person who administers or owns any Linked Site.

These Terms and Conditions shall be construed in accordance with and shall be governed by the laws in force in the Philippines.

For transactions on this website, you may pay with any credit/debit card. For transactions at ticket counters, you may pay with BDO Pay, GCash, GrabPay, PayMaya, WeChatPay, Alipay, and debit/credit card (currently available in select branches).

You will receive an email confirmation upon successful purchase.

In order for SM Cinema to provide this online service, we add a minimal charge as an online fee. By purchasing tickets online in advance, you are guaranteed a seat and avoid a sold-out showing.

Tickets purchased are strictly non-refundable and non-cancellable.

In the unusual situation that a movie is cancelled or the cinema is not able to operate, you will be entitled to a refund of your tickets. Your refunds will be effected through the same medium by which your tickets were purchased (credit card, debit card, or mobile wallets).

A block screening is a private rental for current theatrical releases. It follows the cinema’s current movie schedule.

A theater rental is rental for multiple use, e.g., parties and events - private, corporate and religious gatherings.

Your Premium membership will expire after 12 months from date of admission to the Premium membership program, unless otherwise renewed. Once your Premium membership expires, you will be automatically enrolled under Basic membership.
